PLEASE REVIEW THESE TERMS CAREFULLY. BY REGISTERING FOR AN ACCOUNT OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT, INCLUDING ANY UPDATES OR REVISIONS TO THE TERMS OR ANY POLICY.
Utilization of the pre-recorded practice video interviewing tools offered by Qprofiles is entirely discretionary. In the event that a participant in a video interview chooses to use any of the available video capabilities, they agree to abide by these Terms of Use, in particular the terms contained within this Section.
You expressly authorize Qprofiles to enable video recording of your interviews, to record such interviews, to store the recordings of such interviews, and to use the interviews to provide the Qprofiles Services when you participate in any interviews. This authorization is given when you participate in any interviews. In addition, you explicitly grant the participants in such interviews permission to access recordings of the interviews and to do so on many occasions. This permission is valid for as long as the interviews are kept. In addition, by submitting your interviews to Qprofiles, you provide express permission to Qprofiles to share them with their Third-Party Customers, who may or may not also be Qprofiles customers. Customers who use Qprofiles Services are deemed to have agreed to be bound by these Terms of Service as well as any other Qprofiles rules that may be applicable, such as, but not limited to, its Privacy and Security Policy. Candidates do have the option, however, of submitting their recordings for feedback from Third-Party Customers (experts), who (a) may or may not be Qprofiles customers and, if they are, (b) may not have consented to these Terms of Use and any other Qprofiles policies that may be applicable. You need to be aware that Qprofiles does not have any control over how Third-Party Customers who do not directly become Qprofiles customers utilize the candidate information that they have access to. As a consequence of this, Qprofiles is unable to accept responsibility for the management of candidate information that is handled by Third-Party Customers who do not directly utilize Qprofiles Services.
You acknowledge that Qprofiles is unable to regulate how Third-Party Customers will use the information you submit to them when you use our services, but you agree to provide such information to them nevertheless.
You might have the ability to share your information with third parties/Experts for input if you affirmatively provide them access to such information. This would be done in the same way as the previous example. You ought to be aware that QPROFILES is unable to control the actions taken by third parties (Experts) who have access to your information or information similar to it. As a consequence of this, you accept full responsibility for any use that may be made of your information or access that may be granted to it by third parties to whom you supply your information or access to it.
The Qprofiles Services may only be utilized for perfectly legal endeavors. When you register for QPROFILES Services or buy products from Qprofiles, you agree to supply the company with information that is truthful, accurate, and up-to-date as requested. Should you fail to do so, you will be in violation of these Terms and Conditions of Use.
Candidates are required to give specific information in order to gain access to the Pre-recorded Video Interviewing Service. Please take note that you are not permitted to use a Display Name that impersonates another person; violates the intellectual property rights of a third party; is offensive or unsuitable, or contains any combination of these factors.
Every consumer is required to give their consent to these Terms of Use as well as any additional agreements that may apply. You agree to take full and complete responsibility for any and all use of the Qprofiles Services that occurs via your Account, regardless of who was using such services. As a User of Qprofiles, you are not permitted to provide anyone else permission to use your account in any way.
Your username, account, and/or password may not be shared with or given to any other individual or organization under any circumstances.
You are obligated to immediately notify QPROFILES of any obvious security breach, such as the loss, theft, or unauthorized disclosure or use of a Username or password.
The following activities are expressly prohibited when using the QPROFILES Services:
Intentionally or accidentally breach any applicable local, state, national, or international law, or any rules or regulations thereunder; Intentionally or unintentionally engaging in conduct that is likely to result in civil or criminal liability; A violation of any intellectual property rights belonging to a third party that was committed on purpose; Disseminating or posting content that is harmful, including but not limited to computer viruses, Trojan horses, worms, spyware, or any other computer programming routines that may damage, interfere with, secretly intercept, or seize any system, program, data, or personal information; Spreading materials that QPROFILES, in its sole judgment, deems to be sexually explicit, derogatory, inflammatory, harassing, threatening, defamatory, or otherwise undesirable; Publish or transmit any nudity through the QPROFILES Services, or cause any nudity to be published or communicated through those services; Through the use of the Qprofiles Services, posting or transmitting, or causing to be posted or sent, any unsolicited bulk email; Within its QPROFILES Services, QPROFILES enforces a stringent policy that prohibits the sending of spam and any other inappropriate use of email services.
Using the QPROFILES Services to post or transmit, or cause to be posted or transmitted, any promotional materials for a company other than QPROFILES, or causing such materials to be posted or sent; If in the future QPROFILES decides to dedicate a particular topic to the promotion and/or offering of services by Customers, then additional and/or different rules may need to be followed by users of that forum. Customers are not permitted to publish any reviews about themselves on QPROFILES that are deemed to be phony, fraudulent, or otherwise inaccurate under any circumstances. To assume the identity of any other person; To supply any information that is not true; After having your account canceled or suspended by QPROFILES for any reason, registering or attempting to register a new account with QPROFILES without QPROFILES's express authorization; and/or making an attempt to circumvent the safety precautions taken by QPROFILES.
Customers who have reason to believe that another user has violated any of the aforementioned terms and conditions are obligated to promptly report their suspicions to QPROFILES by sending an email to the security email address located on the QPROFILES website.
A Customer is required to immediately alert QPROFILES via security@qprofiles.com of any error, omission, or violation of the Terms of Use by any other third party upon learning of such an error, omission, or violation.
Customers take full responsibility for everything they acquire from QPROFILES Services, regardless of whether the item is for the customer's own use or for the use of another else.
IN NO EVENT WILL QPROFILES, ITS OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, REPRESENTATIVES, LICENSORS, SUCCESSORS OR ASSIGNS; OR ITS SUBSIDIARIES'/SUPPLIERS' OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, REPRESENTATIVES, LICENSORS, SUCCESSORS OR ASSIGNS, BE LIABLE TO YOU OR TO ANY THIRD PARTY WHATSOEVER FOR ANY DAMAGE INCLUDING, BUT NOT LIMITED TO, INDIRECT, DIRECT, SPECIAL, PUNITIVE, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT L
QPROFILES SHALL BE EXCUSED FOR ANY DELAY OR FAILURE TO PERFORM DUE TO ANY CAUSE BEYOND ITS REASONABLE CONTROL. THIS INCLUDES, BUT IS NOT LIMITED TO, ACTS OF GOVERNMENT; NATURAL CATASTROPHES; FORCE MAJEURE; ACTS OF GOD; INTERNET DISRUPTIONS OR UNAVAILABILITY; FAILURE OF OPERATING SYSTEMS;
YOU AND ANY THIRD PARTY SHALL NOT HOLD QPROFILES LIABLE FOR ANY MODIFICATION, SUSPENSION, OR DISCONTINUATION OF THE QPROFILES SERVICES. QPROFILES SHALL NOT BE LIABLE. SIMILARLY, QPROFILES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY SHOULD UPDATE TO THE SOFTWARE OR CODE THAT REQUIRE THE INSTALLATION OF OTHER THIRD-PARTY SOFTWARE. QPROFILES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY SHOULD THIS OCCUR. YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR
(i)THE USE OR THE INABILITY TO USE THE QPROFILES SERVICES; (ii) THE COST OF PROCURING SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE QPROFILES SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTER QPROFILES SHALL NOT BE LIABLE FOR ANY DAMAGES THAT EXCEED THE TOTAL AMOUNT THAT THE USER HAS PAID TO QPROFILES. QPROFILES SHALL NOT BE HELD LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR CONNECTED WITH THESE TERMS OF USE OR WITH ANY OF THE SERVICES PROVIDED HEREUNDER. THIS IS TRUE REGARDLESS OF WHETHER THE DAMAGES WERE CAUSED BY QPROFILES, ITS AGENTS, EMPLOYEES, SUBSIDIARIES
The Website, Apps, and QPROFILES Services may be modified or discontinued at any time at the sole discretion of QPROFILES, who reserves the right to do so either temporarily or permanently. Any changes made to any of the QPROFILES Services, such as the release of new features, tools, or resources, are subject to these Terms of Use as well as any other policies that may be applicable. Alterations are possible at varying intervals. Notification of any changes or updates shall be provided through the Website and/or Apps (as applicable) and, as applicable, other forms of notice that are provided in this document. The validity of the Terms of Use shall not be affected in any way by the absence of any notice beyond changes that are made to the Website.
It is possible for QPROFILES to change its software and/or its code, either completely or partially. Because of these changes, it's possible that your computer will need to install additional software from a third party.
QPROFILES maintains the right, but not the responsibility, to delete posts and/or Content that, in its sole discretion, it deems to violate these Terms of Use. However, QPROFILES is not required to do so. The fact that QPROFILES does not delete any post does not indicate that it agrees with the content of any post, regardless of whether or not it was deleted. QPROFILES disclaims any and all liability for any false, libellous, slanderous, or otherwise offensive Content that is posted by its customers. It is important to note that Qprofiles is not an employment agency. The Qprofiles pre-recorded video interview series is intended solely for the purposes of practice and personal evaluation. There is no assurance provided by Qprofiles that any individual or organisation will be successful in finding employment or a worker via the use of Qprofiles Services.
ACKNOWLEDGEMENT
You acknowledge that you have read all of the conditions included above, that you understand them, and that you agree to abide by them.
CLASS ACTIONS WERE NOT PRESERVED.
You also waive, in no uncertain terms, any right you may have had to join in any class action lawsuit filed against QPROFILES for any claims relating to the Website, Apps, and/or QPROFILES Services. In point of fact, by using the Website, Apps, and/or QPROFILES Services and agreeing to these Terms of Use, you are expressly agreeing that you will not be permitted to resolve any claims against QPROFILES through the use of class actions. This is a condition of your use of the Website, Apps, and/or QPROFILES Services.
ENTIRE AGREEMENT
The Parties concur that any and all prior understandings, agreements, or representations by or among the Parties, whether written or oral, that may have related to the subject matter of this agreement in any way, supersedes and pre-empts the Terms of Use as it shall be modified from time to time and constitutes the full and complete understanding among them with respect to the subject matter hereof. Any Consumer and/or Customer of the Website, Apps, and/or QPROFILES Services shall indemnify and hold QPROFILES, the owners and operators of QPROFILES, as well as their subsidiaries, officers, agents, directors, and employees, harmless against any and all claims, expenses and/or losses, including reasonable legal fees (including but not limited to attorney’s fees, costs, and expenses), made by any third party against QPROFILES due to or arising from your use of and/or connection to the Website, Apps and/or QPROFILES Services; or from the information you sent, submitted, electronically received, viewed, printed, downloaded, or transmitted through the Website or Apps; your connection to the Website; your use of the Apps; your violation of these Terms of Use; or your violation of any rights of any other person or entity.

This provision applies even if QPROFILES did not insist upon the performance of any of the terms of this Terms of Use in any one or more instances. No employee, agent, or representative of QPROFILES, including, but not limited to, a customer service representative, shall have the authority to waive any term of the Terms of Use or any other agreement or policy pertaining to QPROFILES.
Notices supplied to you by QPROFILES for any reason (including changes to this Agreement, the Service, the fees, or other items of a similar nature) may be made via a general posting on the Website. QPROFILES is not obligated to provide you with such notices.
