The current version of the Promotions Policy was most recently modified on November 14th, 2022.
This Promotions Policy (the "Policy") offers information about the various techniques that Qprofiles experts can use to promote their content. Some of these strategies include the usage of expert coupons, referral links, and Qprofiles' optional marketing programs. Our Terms of Use and Expert Terms both make reference to this Policy, which means they are legally bound by it. The definitions of any capitalized terms that aren't included in this Policy can be found in the Terms of Use or Expert Terms.
You can opt into Qprofiles' Promotional Programs by visiting the Promotional Agreements page of your expert settings or by entering into a written agreement (including via email) with Qprofiles for certain programs, as described in more detail below. Qprofiles allows prime experts to participate in Qprofiles' Promotional Programs.
Qprofiles retains complete authority over pricing decisions, as well as the selection of content that will be made available as part of the various Promotional Programs. Qprofiles has the right to remove any of your content from the Promotional Programs at any time and in its sole discretion, with or without prior notice to you. This decision may be made with or without regard to whether or not your content was removed. In conjunction with the Promotional Programs, Qprofiles does not guarantee the achievement of any particular minimum degree of success. There is a possibility that certain aspects of the programs that are available will evolve over time. It is not possible to make each and every offer or program available in each and every geographical region or for each and every piece of material on Qprofiles.
The Qprofiles Deals Program helps to enhance your potential revenue by enabling Qprofiles to offer your content at an enticing discount as part of targeted promotions, in addition to optimizing your list pricing. This gives Qprofiles the ability to help you raise your revenue.
If the sale of your content to a Qprofiles reseller or distributor results in a sale price that is lower than what is permitted by this Policy, Qprofiles will calculate your revenue share based on the Gross Amount that is permitted by this Policy. This will ensure that you receive the maximum amount of revenue possible. The period of the bargains that are offered through the Deals Program can vary, and they can be marketed either through the Services itself, user communications, or third-party platforms.
You are free to withdraw from the Deals Program whenever you like. Despite this, your content will continue to be subject to any applicable sales, campaigns, or promotions that are currently ongoing at the time you opt-out and will continue to be subject to them until they are finished.
Our membership program, which is referred to as the "Qprofiles Subscription Program," is open to Prime experts as well, provided they adhere to the additional terms outlined in this section. The Qprofiles Subscription Program is comprised of Qprofiles' subscription-based content collections, which are made available to individual consumers and business customers (collectively referred to as "Subscription Customers"). These content collections feature a hand-picked selection of Qprofiles’ best content for professional and personal development skills.
When you sign up for the Qprofiles Subscription Program, you agree to make all of your content suitable for inclusion in the content collections accessible via paid subscription on Qprofiles. We reserve the right to choose whether or not to include any of your material in any collection, including any add-on, variation, or a subset of that collection, and we reserve the right to change the decision at any time and for any reason, we see fit.
Due to the fact that access to the collections is granted on a subscription basis, we reserve the right to set selling prices and provide free trials. If your work is already part of a collection, you won't be able to unpublish it or make it private until the collection is removed.
You are additionally subject to the extra terms outlined in Section 4 if you have consented to give any Assessment Questions (which will be described in the next paragraph) (Assessments).
The conditions of this section apply to all experts who have participated in the "Qprofiles Subscription Program" and opted into those programs.
You acknowledge and agree, as a condition of your participation in the Qprofiles Subscription Program, that your revenue share will be determined for each collection in the following manner:
Each month, Qprofiles will calculate the total monthly subscription fees paid to Qprofiles on behalf of all current Subscription Customers of such collection, minus any applicable Transaction Taxes, foreign exchange fees, and third-party fees, such as reseller, promotion, distribution, or payment processing fees. These fees will be deducted from the total monthly subscription fees paid to Qprofiles on behalf of all current Subscription Customers.
The experts who take part in such a collection will each receive minimum of twenty-five percent and can earn up to (30-40%) of this amount as their share of the "Expert Revenue," based on the criteria as set by Qprofiles and level of expertise in the given area. This section may be updated to identify additional types of content that will be included in the calculations to determine the Expert Revenue as Qprofiles makes additional forms of content (such as assessments and expert evaluation) available through the collections.
Once your content is included in a collection, you agree that you will not begin to offer any on-demand content, such as pre-recorded courses, that directly compete with or harm the sales of that content on any site or platform other than your own. The only exception to this rule is the provision that states otherwise for assessment questions, which can be found further down in this section. In the event that you decide to withdraw from the Qprofiles Subscription Program, you acknowledge and accept that this exclusivity condition will continue to be in effect until such time as we have removed all of your content from any and all collections.
You are free to decide at any time that you no longer wish to be a part of the Qprofiles Subscription Program and can do so by sending an email to expertsupport@qprofiles.com. Your material will be removed from the collections within a year after the termination of your Qprofiles account, and Qprofiles will continue to pay you revenue share based on the rates that were in effect at the time until your content is removed from the collection in question.
Subscription Customers will no longer be able to enroll in your content after it has been removed from a collection for whatever reason, and you will no longer earn a revenue share from that collection. Once your content has been removed, Subscription Customers will no longer be able to access your content. On the other hand, any individual end user who has already been enrolled in your content will continue to have access to that content for as long as they are subscribed to the collection that is relevant to the issue at hand.
The assessments provided by Qprofiles (referred to as "Assessments") are comprised of question and answer pairs with explanations (each of which is referred to as an "Assessment Question") to evaluate a user's level of knowledge and learning in relation to specific topics, skills, domains, or occupations.
Qprofiles makes a series/collection of mock tests, model exam papers, mock interviews, and other types of evaluations available to users as stand-alone content options, distinct from courses.
You are indicating that you agree to the terms outlined in this section by submitting an Assessment Question in accordance with the written agreement we have both reached (which may include communication via email).
We reserve the right to choose whether or not to include your Assessment Question in the Qprofiles Subscription Program, and we reserve the right to alter this option at any time and for any reason at our sole discretion. If your Assessment Question is selected to be included in the Qprofiles Subscription Program, then you agree to be bound by the terms that are relevant to that program, which are outlined above.
You agree that your Assessment Questions will conform with any and all criteria that may be agreed upon in writing (including via email) by both you and Qprofiles. These criteria may include the topic, format, domain, level of difficulty, and the number of questions.
By submitting your Assessment Question, you grant Qprofiles an exclusive license to use, copy, reproduce, distribute, display, publish, and create derivative works based on your Assessment Question. This license allows Qprofiles to use, copy, reproduce, distribute, display, and publish your Assessment Question. You agree that you will not make your Assessment Question available to other people (including through your own site or platform), license, or permit any third party to do so and that you will not share your Assessment Question with others.
You are free to cancel your subscription to an Assessment Question at any time by sending an email to the following address: expertsupport@qprofiles.com.
Your Assessment Question will be removed from the Services by Qprofiles within a year after the termination of your subscription, and Qprofiles will continue to pay you any relevant revenue share based on the rates that were in effect at the time until your Assessment Question is removed from the applicable portion of the Services.
We reserve the right to make modifications to this Policy at any time in order to explain our policies, reflect new or different practices, or both. In the event that we make any significant modifications to our services, we will make every effort to contact you through obvious channels, such as sending a notification to the email address you have listed for your account or publishing a notice on our websites. Unless explicitly specified otherwise, any changes that are made will take effect on the day that they are posted.
